Employee monitoring is legal in most jurisdictions when conducted transparently and for legitimate business purposes, but the specific requirements vary by country, state, and employment type. As the account administrator, you are solely responsible for complying with all applicable laws before deploying monitoring in your organization.

Notify employees in advance. Most U.S. states and many countries require that employees be informed of monitoring before it begins. A written policy in your employee handbook or a signed acknowledgment is standard practice.
Monitor company-owned devices only. Monitoring personal devices — even when used for work — carries significantly higher legal risk and may require explicit consent beyond standard employment agreements.
Define a legitimate business purpose. Monitoring for productivity, security, or compliance purposes is generally protected. Monitoring for punitive or retaliatory purposes is not.
Review state and local laws. States including Connecticut, Delaware, and New York have specific employee monitoring notice laws. The EU, UK, and Canada have additional GDPR/PIPEDA obligations for remote workers in those regions.

Yes — and in many jurisdictions, telling employees is not just recommended, it's legally required. Most U.S. states and countries require advance notice before workplace monitoring begins. We strongly recommend a written monitoring policy in your employee handbook and a signed acknowledgment from each monitored employee. Pulse is designed for authorized, transparent workplace monitoring by account administrators only.

A device is counted as active when it has the Pulse monitoring agent installed and has reported activity during the billing period. Devices that are deactivated are not billed.
